1. Introduction
Welcome to RYZZFIT! By accessing and using our website, mobile applications, and services, you agree to comply with and be bound by these Allgemeine Geschäftsbedingungen (AGB), or terms and conditions. These AGB govern the legal relationship between you, the user, and RYZZFIT, and outline the terms under which our services are provided. If you do not agree to these terms, please refrain from using our services.
2. Scope of Services
RYZZFIT offers a range of fitness-related services, including but not limited to personal training sessions, group classes, fitness plans, nutritional advice, and access to fitness resources via our website and mobile application. These services may be provided in person, online, or as a combination of both. The scope and availability of these services may vary based on location and subscription type.

3. Eligibility
3.1 General Eligibility:
RYZZFIT services are available to all individuals who have legal capacity. However, individuals under the age of 18 must respect the sub-sequent specifications (3.2, 3.3, 3.4).

3.2 Age Restrictions:
RYZZFIT services are not available to individuals under the age of 16. Users must be at least 16 years old to access and participate in any of our services.
3.3 Minors Aged 16 to 17:
Minors who are 16 or 17 years old may access RYZZFIT services only with written consent from a parent or legal guardian. The consent must be provided before any participation in services and must include:

3.4 Verification of Age and Authorization:
RYZZFIT reserves the right to request proof of age to any of his user who declared himself as "adult" during the registration process. This may include, but is not limited to, a copy of an official identification document and a signed consent form. Failure to provide such documentation upon request may result in suspension or termination of the user’s access to our services.
3.5. Acceptance of Risk and Liability:
Inherent Risks: Participation in fitness services offered by RYZZFIT involves inherent risks, including but not limited to risks of physical injury, discomfort, or other health-related issues. By engaging in our services, users acknowledge and accept these risks. The services include any activity provided by Ryzzfit : test training session, memberships, group training, workshops, diet plans, workout plans (non-exhaustive list, for example purposes only).
Full Responsibility: Users agree to assume full responsibility for their own health and safety while participating in RYZZFIT services. This includes ensuring that they are in adequate physical condition to safely engage in the activities and acknowledging that they have no known medical conditions or limitations that would affect their ability to participate safely.
Liability Waiver: Users agree to indemnify, defend, and hold harmless RYZZFIT, its employees, agents, and affiliates from any and all claims, liabilities, losses, damages, or costs arising out of or related to their participation in the services. This includes, but is not limited to, any claims for personal injury, property damage, or other losses that may occur as a result of participation.
4. Account Registration and Security
4.1 Account Creation:
To access the community features of our services, users may be required to create an account by providing accurate and complete registration information. Users agree to maintain the confidentiality of their account credentials and are responsible for all activities conducted under their account.
4.2 Account Security:
Users must notify RYZZFIT immediately if they suspect any unauthorized access or use of their account. RYZZFIT is not liable for any losses or damages arising from unauthorized use of an account due to user negligence.
4.3 Account Termination:
RYZZFIT reserves the right to terminate or suspend a user's account at any time for violations of these terms, suspected fraud, or misuse of our services. In such cases, the user may lose access to any prepaid services without a refund, subject to the specific circumstances of the termination.
5. Booking Policies
5.1 General Booking Policy:
Clients are encouraged to book sessions or classes in advance through the RYZZFIT website or directly contacting the trainers. Early bookings can be made up to one month in advance, and late bookings are permitted within 24 hours of the session start time, subject to availability. Any session booking only becomes valid once confirmed by the corresponding trainer. This booking confirmation need also apply to membership owners. RYZZFIT owes the right to not confirm a session without being required to provide any justification.
5.2 Cancellation and Rescheduling:
Clients have the right to cancel or reschedule their booked sessions or classes up to 24 hours before the scheduled start time without incurring any charges. Cancellations or rescheduling requests made within 24 hours of the session may result in the full session fee being charged. In case of memberships, last minute (24h) cancellation may be removed from the plan (as if the session was performed).
5.3 Late Cancellations and No-Shows:
In the event of a late cancellation (within 24 hours of the session) or a no-show, RYZZFIT reserves the right to charge the full session fee. This policy is in place to compensate trainers for their time and to ensure fair access to available slots for other clients.
5.4 RYZZFIT based cancellations
RYZZFIT own the right to cancel sessions without being required to provide any justification. For the case of single class booking, RYZZFIT initiated cancellation would lead to a total refund. For the case of a membershio booking, RYZZFIT initiated cancellation would lead to a re-schedule of the corresponding class within 10 days. If no reschedule time fits the customer and at least 3 reschedule options are not provided, the customer would be refunded for the corresponding session,
6. Payment Terms
6.1 Pricing:
All prices for RYZZFIT services are listed on our website and mobile application. Prices are subject to change, and users will be notified of any price changes in advance. All prices include applicable VAT unless otherwise stated.
6.2 Payment Methods:
Payment for RYZZFIT services is required in advance and can be made through secure payment methods, including credit/debit cards, PayPal, or other approved payment platforms. Users are responsible for ensuring that their payment information is accurate and up to date.
6.3 Invoices and Receipts:
Upon successful payment, users will receive an electronic invoice or receipt via email. Users should retain this document for their records. RYZZFIT does not send paper invoices unless explicitly requested by the user.
6.4 Late Payments:
In the event of late payment, RYZZFIT reserves the right to charge statutory default interest in accordance with German law. RYZZFIT may also suspend access to services until payment is received. Users will be notified in advance of any suspension of services due to non-payment.
7. Refund Policy
7.1. General refund condition
Cancellation within 14 Days: In accordance with German law, customers have the right to withdraw from their purchase within 14 days of the contract being concluded. This applies to both single sessions and memberships purchased online.
Services Commenced During the Withdrawal Period: If the service (such as a training session) has already begun within the 14-day withdrawal period, customers may still cancel but will only be refunded for the portion of the service not yet provided.
​Cancellation after 14 Days: Beyond a 14 days time after purchase, only medical invalidity of more than 14 days ora permatent moving out of Berlin can lead to a refund (if requested). For both of these cases, official proofs must be provided. Only the not-already performed classes will be refunded.

7.2. Refund Amount
Full Refund: Customers who cancel their purchase within 14 days and before the service has commenced are entitled to a full refund of the total session or membership fee.
Partial Refund: If the service has already started during the 14-day period, customers will receive a partial refund, calculated based on the portion of the service already provided.

7.3. Request demand method
To request a refund, customers must contact our customer support team within 14 days of purchase. Refund requests can be made via email at info@ryzzfit.de or by contacting us at +4917681403141.
7..4. Refund Processing
Once a refund request is received and verified, we will process the refund within 5-7 business days. The refund will be issued to the original payment method used for the purchase.
7.5. Not refundable cases
Please note that the following situations are not eligible for refunds:
1. Cancellations made after the 24-hour window.
2. No-shows or missed appointments.
3. Services rendered beyond the cancellation period.
7.6. Changes to the Refund Policy
RYZZFIT reserves the right to modify or update this refund policy at any time, but any changes will comply with German law. Any changes to the policy will be effective immediately upon posting on our website.
By purchasing our services, you agree to abide by the terms and conditions outlined in this refund policy.
8. Privacy and Data Security
8.1 Data Protection:
RYZZFIT is committed to safeguarding your privacy and complies with the General Data Protection Regulation (GDPR) and other applicable data protection laws in Germany. We collect, store, and process personal data only to the extent necessary to provide our services and improve the user experience.
8.2 Data Collection:
RYZZFIT collects personal information such as names, contact details, payment information, and fitness-related data when users register or use our services. This data is collected for the purpose of delivering personalized services, processing payments, and maintaining communication with users.
8.3 Data Security:
RYZZFIT implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or destruction. User data is stored securely and is only accessible by authorized personnel.
8.4 Third-Party Sharing:
RYZZFIT does not share personal data with third parties without user consent, except as required by law or when necessary to provide our services (e.g., payment processing). Any third-party service providers used by RYZZFIT are contractually obligated to comply with data protection regulations.
8.5 User Rights:

9. Intellectual Property
9.1 Ownership:
All content on the RYZZFIT website and mobile application, including but not limited to text, graphics, logos, images, videos, and software, is the property of RYZZFIT or its licensors and is protected by copyright, trademark, and other intellectual property laws.
9.2 User License:
RYZZFIT grants users a limited, non-exclusive, non-transferable license to access and use the content provided on our platform for personal, non-commercial purposes. This license does not grant any ownership rights to the content.
9.3 Prohibited Use:
Users are prohibited from copying, reproducing, distributing, modifying, or creating derivative works from any content on the RYZZFIT platform without prior written consent from RYZZFIT. Unauthorized use of any content may result in legal action.
10. Liability Disclaimer
10.1 General Disclaimer:
While RYZZFIT strives to ensure that all information provided on our platform is accurate and up-to-date, we do not guarantee the completeness, accuracy, or reliability of any content. Users rely on the information provided at their own risk.
10.2 Limitation of Liability:
RYZZFIT’s liability for damages arising from the use of our services is limited to cases of gross negligence or intentional misconduct. In the event of personal injury, death, or damage to health caused by RYZZFIT’s negligence, liability is governed by mandatory statutory provisions.
10.3 User Responsibility:
Users acknowledge that participating in fitness activities carries inherent risks. RYZZFIT is not liable for any injuries, losses, or damages sustained during the use of our services, except where liability is mandatory under German law.
11. User Conduct
11.1 Prohibited Activities:
Users agree not to engage in any unlawful, harmful, or abusive activities on the RYZZFIT platform. This includes, but is not limited to, harassment, spamming, hacking, spreading malicious software, or violating the privacy of other users.
11.2 Account Termination:
RYZZFIT reserves the right to terminate or suspend a user’s account if they violate these terms, engage in prohibited activities, or misuse

12. Membership - Service interuption
12.1. Intruption due to trainer's medical condition
In case a trainer's medical conditions is not sufficient to perform his session, RYZZFIT will try as fast as possible to re-schedule the corresponding classes with one other RYZZFIT trainer. However, in case this option is not possible, the maximum duration of the service interuption will be 21 days. After this period, all the remaining classes in the membership are available for refund (independently from the time since purchase).

12.2. Interuption due to the RYZZFIT gym's access
In case the RYZZFIT gym access is impossible (re-work or any other external reason), RYZZFIT will try as fast as possible to re-schedule the corresponding classes in a secondary location. However, in case this option is not possible, the maximum duration of the service interuption will be 21 days. After this period, all the remaining classes in the membership are available for refund (independently from the time since purchase).

12.3. Interuption due to the force majeure event, indepent from RYZZFIT control
12.3.1 Definition:
For the purposes of these terms and conditions, “Force Majeure” refers to any event or circumstance beyond RYZZFIT's reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, civil unrest, strikes, lockouts, or government actions, that prevents or delays the performance of RYZZFIT’s obligations.
12.3.2. Impact on Obligations:
In the event of Force Majeure, RYZZFIT shall be relieved from the performance of its obligations under these terms for the duration of the Force Majeure event. RYZZFIT will make reasonable efforts to mitigate the impact of the Force Majeure event and resume performance as soon as possible.
13.4.3. Notification:
RYZZFIT will notify users of the occurrence of a Force Majeure event and its potential impact on the services. Such notification will be made within a reasonable timeframe after RYZZFIT becomes aware of the Force Majeure event.
13.4.4. Resolution:
If the Force Majeure event persists for a period exceeding 30 days, either party may terminate the agreement with immediate effect by providing written notice. In such cases, any fees paid for services not rendered due to the Force Majeure event will be refunded or credited, as applicable.

14.1 Accessibility: RYZZFIT is committed to ensuring that its website and services are accessible to all users, including those with disabilities. We strive to comply with relevant accessibility standards and continuously work to improve the usability of our digital platforms.
