1. Contracting Parties & Scope

1.1 Who we are. "RYZZFIT" (including the women-focused brand "HERA") is a commercial brand used by a network of self-employed personal trainers and coaches ("Providers") operating in Berlin. Unless otherwise stated in your invoice, your contractual counterparty is the individual Provider named on your invoice; RYZZFIT functions as a brand and coordination platform.

1.2 What these terms cover. These Terms apply to all services offered under RYZZFIT/HERA, including: personal training (individual and partner), assessments, group training, plans, nutrition guidance, app/online access, events, and promotions.

1.3 Acceptance. By booking or participating in any service, or by using our website/app, you accept these Terms in full.

2. Services & Third-Party Relationships

2.1 Scope of services. Services may include assessments, individual programming, coaching (in-person or online), progress reviews, and general nutrition support.

2.2 Urban Sports Club / Wellpass. Personal Training is not included in USC/Wellpass memberships. Separate booking and payment with RYZZFIT/your Provider is required. Access through USC/Wellpass follows their own rules.

2.3 Third-party facilities (e.g., EVO Fitness).

• Venue only. EVO Fitness provides the facility but is not a party to your contract.
• House rules. While on EVO premises you must follow their house rules. EVO may refuse entry if rules or fees are not respected.
• Liability. Issues with EVO memberships, access cards, closures or equipment are solely between you and EVO.
• Closures. If a facility becomes unavailable and we cannot relocate or reschedule within 21 days, you may request a pro-rata refund for unused PT sessions (complimentary extras excluded).

3. Eligibility, Health & Safety

• Minimum age: 16 (ages 16–17 require written parental consent).
• You must disclose relevant medical conditions (cardio/respiratory, musculoskeletal, pregnancy, recent surgery, medication, etc.).
• Trainers may request medical clearance at any time.
• You must immediately update us on any new health conditions.
• Trainer instructions must be followed. Refusal may lead to session termination without refund.
• Participation is at your own risk (see Liability § 11).

4. Bookings, Validity, Scheduling

4.1 Advance payment. Sessions begin only after full payment, except for free trials.

4.2 Validity. All purchased sessions are valid for 12 months.

4.3 Rescheduling & no-shows.

• ≥ 24h notice: free reschedule
• < 24h notice or no-show: session charged in full
• Late arrival > 15 min: session may be counted as used

4.4 No auto-renewal. Packages end once sessions are used or expired.

5. Prices & Payments

• All prices include VAT where applicable.
• Payments are processed online via approved providers (e.g., Stripe).
• Installments may be offered at our discretion.
• Price changes apply only to future purchases.
• Discount codes may be withdrawn at any time.
• Only PT sessions carry monetary value. App access, WhatsApp support, nutrition advice, and community extras are complimentary and non-refundable.

6. Right of Withdrawal & Refunds

6.1 Statutory right. Under German Civil Code (BGB §§ 312g, 355), consumers have 14 days to withdraw if booked online/phone.

6.2 Early start. If you request to begin within 14 days:

• You must pay proportionate value for services already delivered plus an admin/programming fee (€50 individual / €100 duo).
• Once your package is fully performed, the withdrawal right expires (§ 356(4) BGB).

6.3 RYZZFIT standard refund framework:

• Full refund if no sessions used and withdrawal valid.
• Partial refund: unused sessions minus admin fee.
• Non-refundable: cancellations < 24h, no-shows, removals for safety/conduct breaches.

6.4 Refund processing. Refunds are processed within 14 business days to the original payment method.

7. Partner Training

• Duo = 2 clients with 1 trainer.
• Each partner is responsible for their own attendance.
• One partner's no-show does not cancel the other's session charge.

8. App & Digital Content

• App access may be complimentary with packages or offered as a subscription.
• Availability is not guaranteed.
• Provided "as-is," without performance guarantees.
• Sharing login credentials is prohibited.

9. Conduct & Safety

• You are responsible for personal belongings.
• Follow hygiene and house rules at all times.
• Sessions will not take place in hotel gyms.
• Incidents must be reported immediately to trainer and venue staff.

10. Suspension & Termination

• We may suspend or terminate services without refund for: rule violations, undisclosed health risks, misconduct, misuse of USC/Wellpass access, or serious disruptions.
• Clients may terminate anytime; refunds follow § 6.

11. Liability

• Unlimited liability applies for intent, gross negligence, personal injury, or under the German Product Liability Act.
• For slight negligence of essential duties, liability is limited to typical, foreseeable damages.
• No liability for third-party facility issues (e.g., EVO).

12. Data Protection

• Data controllers: the individual Provider invoicing you; RYZZFIT may act as joint controller.
• Processing under Art. 6 GDPR (contract, consent, legitimate interest).
• Health data only with explicit consent.
• Retention: up to 5 years unless longer legally required.
• Your GDPR rights: access, rectification, deletion, restriction, objection, portability.

13. Intellectual Property

All RYZZFIT/HERA content (programs, media, branding) is protected and may not be shared or reproduced without permission.

14. Media & Content

• All photos/videos are illustrative and may include stock/AI media.
• No guaranteed results; outcomes vary individually.
• We do not diagnose, treat, or cure medical conditions.
• Third-party brands (e.g., USC, Wellpass, EVO) are trademarks of their owners.

15. Force Majeure

We are not liable for delays caused by events beyond our control (e.g., pandemics, natural disasters).

16. Complaints & Jurisdiction

• Consumers may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr
• Jurisdiction: Berlin, unless mandatory consumer courts apply.

17. Changes to Terms

We may update these Terms where required. Continued use after changes means acceptance.

18. Severability

If any provision becomes invalid, the remaining terms remain in force.
